YOUR BOOKING
Your contract for holiday bookings made through the site is with Exclusive Holidays Ltd.
You will receive an email confirming we have received your online booking. No contract for the sale of any product will subsist between you and Exclusive Holidays Ltd until you have received your confirmation paperwork via post which will confirm our acceptance of your offer to book one of our holidays.
You must check that the details on this confirmatory paperwork are correct as soon as possible. You should print any emails out and keep a copy.
Exclusive Holidays Ltd reserves the right to refuse a booking.
You agree that e-mail can be used as a long-distance means of communication. Correspondence will be conducted between Exclusive Holidays Ltd and the lead name on your booking.
Only clients who have paid in full may travel with Exclusive Holidays Ltd.
Every booking you make shall be deemed performed in England. English law shall govern every aspect of contractual agreement concerning bookings made from the site.
HOLIDAY PRICES
The advertised holiday price includes accommodation, travel, meals and excursions as specified in the holiday itinerary. The holiday price does not include any supplements or insurance, which may be added to your order online. Any optional excursions available can be booked directly with your coach driver, subject to minimum numbers being reached. Admission charges to attractions are not included unless specifically mentioned in an itinerary.
While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. We shall be under no obligation to fulfil an order for a product which was advertised at an incorrect price.
CREDIT / DEBIT CARD PURCHASES
You undertake that all details you provide to Exclusive Holidays Ltd for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.
All credit card / debit card payments made via our website are debited using Paypal. All prices include VAT. VAT is applicable to all bookings.
It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law.
CANCELLATION OR AMENDMENT BY EXCLUSIVE HOLIDAYS LTD
Exclusive Holidays Ltd reserves the right to make changes to an itinerary or use of hotels other than those stated should unforeseen circumstances arise.
We further reserve the right to cancel a trip due to insufficient demand. Notification will be made at least three weeks prior to departure and a suitable alternative offered or a full refund given.
We will not be liable for any other costs incurred, including, but not limited to, travel charges, accommodation fees, cancellation charges, or any consequential damages.
CANCELLATION OR AMENDMENT BY THE CUSTOMER
Any cancellation or amendment by the customer must be made in writing by the person who made the booking. The date of the cancellation will be the date this is received. The following cancellation charges will apply:
56 days prior to departure deposit only
Between 55 and 25 days 50%
Between 24 and 14 days 65%
Between 13 and 4 days 80%
3 days or less 100%
COMPLAINTS
Exclusive Holidays Ltd and hoteliers will not accept complaints regarding the holiday unless they were given the chance to rectify the problem at the time.
INSURANCE
Travel insurance is optional in the UK, but we advise you to take this out where accommodation is included. Most clients are covered for cancellation charges and the benefits listed. Insurance for overseas trips is compulsory. Your insurance documents will be kept safe and given to you upon your departure.

NB: Travel Insurance of any type will not cover you for pre-existing medical conditions, it is therefore essential that you carry a valid European Health Card (replaces E111 form). This will cover you in most eventualities and means that you will not have to pay immediately.
LIABILITY
Exclusive Holidays Ltd does not accept liability for any errors and omissions and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services.
Market Harborough Travel is responsible for all legal requirements regarding the operation of coaches. However we will not be liable for any delay or inconvenience caused by mechanical failure, road works, traffic delays, bad weather or any unforeseen circumstances.
Neither Exclusive Holidays Ltd nor Market Harborough Travel shall have any liability for any change or cancellation of our holidays to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.
We shall have no liability (including liability for negligence) for the acts or omissions of telecommunications service providers or for failures of, or faults in their networks and equipment.
No waiver by us of any breach of these Terms shall be considered as a waiver of any subsequent breach of the same or any other provision.
USE OF WEBSITE
You may not permit, create unauthorized framing of, or deep linking to, the Site or the creation of derivative works thereof from any other website under your management or control.
Subject to the licence granted to you to use the Site, Exclusive Holidays Ltd reserves all rights, title and interest in its Intellectual Property Rights in the Site.
AMENDMENTS TO TERMS & CONDITIONS
Exclusive Holidays Ltd may amend these Terms from time to time, and place the new version on the Site. For users purchasing goods or registering on the Site for the first time, all purchases from the date that the amended terms are placed on our website onwards will be governed by those new terms. Otherwise, such changes will be effective against existing users thirty days following posting of the amended version on the Site. Your continued use of the Site following Exclusive Holidays Ltd's posting of any changes will constitute your acceptance of such changes. If you do not agree to any changes to these Terms, then your only remedy is to cease using the Site.
These Terms supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or in writing, and contain the entire agreement between Exclusive Holidays Ltd and you relating to your purchase. Exclusive Holidays Ltd advises that you print off and keep safe a copy of these terms and conditions once your order has been accepted by Exclusive Holidays Ltd. We will store a copy of the contract entered into by you with Exclusive Holidays Ltd. You are advised to read (and are responsible for reading) fully all information on this website.
If any provision of these Terms shall be held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the remaining parts of these Terms and the remainder of the affected provision shall be unaffected.
These Terms are subject to the laws and exclusive jurisdiction of England and Wales.
The above terms and conditions apply to all holidays and trips organised by Exclusive Holidays Ltd and Market Harborough Travel, and apply to all passengers.
